Read and acknowledge the following statement:
I acknowledge that I am the lawful owner or tenant/lessee of the address indicated on this application for a burn to take place in St. Catharines (the 'property').
I have reviewed the requirements of the City of St. Catharines’ By-law to Regulate the Setting and Maintaining of Open Air Fires (the “By-law”) with regards to Agricultural Fires and I agree to conduct the Agricultural Fire in accordance with the By-law as well as all conditions set forth on the Burn Permit should it be issued.
I understand that failure to follow the conditions set forth in the By-law or the Burn Permit as issued may result in a revocation of the Burn Permit, and/or prosecution for violations of the By-law and/or the Ontario Fire Code.
I further understand that the City may implement cost recovery measures for fee for services to the Property Owner, which may be applied to property taxes.
I acknowledge that open air burning is a high-risk activity and that it poses a danger of damage, injury or death if not conducted safely.
I agree not to undertake any open air burning until such time as a Burn Permit has been issued by the St. Catharines Fire Services.
In consideration of granting the Burn Permit by St. Catharines Fire Services, I hereby release and forever discharge and agree to indemnity and save harmless The Corporation of the City of St. Catharines, its servants, agents, employees and elected officials from any and all actions, causes of action, claims and demands for damages, loss or injuries to persons or property sustained by any person(s) in consequences of open air burning, said burning being the subject of the Permit application.
NOTE: Incomplete applications will be returned without review. Open Air-Burning shall not be conducted until such time as a Burn Permit has been approved and issued. Burn Permits must be available on site at all times while burning is underway. Permits are valid until the last day of the current calendar year. It is the responsibility of the Permit holder to apply for a renewal at least two (2) weeks before the Permit’s expiry.
