Application for cancellation, reduction, refund of property taxes

Under Sections 334, 357 and 358 of the Municipal Act R.S.O. 2001 c.25

In order to file an application for a property tax adjustment, you must be one of the following:

the property owner
the spouse of the owner
the tenant, occupant or their spouse
a person in possession of the land

Please note:

An application under Section 357 must be filed on or before February 28, of the year following the year in respect of which the application is made to be entitled to appeal.

An application under Section 358 must be filed between March 1 and December 31 of a year, and may apply to taxes levied for one or both of the 2 years preceding the year in which the application is made.

An application under Section 334 must be filed on or before December 31 of the fifth year following the year in respect of which the application is made. Recommendations for applications under section 334 received after February 28 of the year following the year of levy are final.

357: Class change; vacant or excess land; exempt; damaged / destroyed; sickness / extreme poverty; mobile unit removed; gross or manifest error; over 3-month renovation.

358: Gross or manifest error in one or both of the prior two years in the preparation of the assessment roll that is clerical or factual in nature, including the transposition of figures, a typographical error or similar errors, but not an error in judgment in assessing the property.

334: Applies to capped classes only Gross or manifest error that is a clerical error, the transposition of figures, a typographical error or similar type of error in the calculation of taxes under this Part.
